LIMITED WARRANTY
Mountain States Sports Equipment (MSSELLC) warrants all products on this website against defects in workmanship and material for one year, from the invoice date, unless otherwise noted on this website. Normal deterioration of products due to weather, wear and tear, normal activity or other causes that do not affect functional use are not covered by this warranty. In no case do we warrant any product's safe and useful life to be greater than the warranty as provided by the equipment manufacturer.
Any alteration, addition to or modification of a product voids all warranties. MSSE reserves the right to replace, refund or repair any product, as appropriate. This limited warranty is exclusive and supersedes all other warranties, expressed or implied. MSSE shall not be liable for any incidental or consequential damages of any nature. This warranty gives you specific legal rights. Other rights or actions which vary from state to state may be available.
All warranties are valid only when the product is properly assembled, installed and used in the specific intended application as outlined in the products printed literature and in accordance with instructions. If instructions are not provided, contact MSSE for a copy.
PRICES
Prices are subject to change without notice. MSSE reserves the right to correct mistakes upon notifying the customer.
PAYMENT TERMS
All orders are subject to credit approval. Payment terms for schools and public institutions are 30 days from invoice date. Other acceptable forms of payment are check and credit card (personal checks are accepted but product will not ship until the check clears the bank). All past due accounts are subject to a 1-1/2% per month (18% per year) interest charge plus collection costs.
ORDERING
MSSE Customer Service Representatives are ready to help you M-F 8:30am-5pm MST. To avoid mistakes or confusion you may email your order to info@mssellc.com. Please verify the accuracy of your order particularly as to shipping instructions, model number, quantities, unit of measure and color. Customers are responsible for all freight charges plus a restocking charge up to 20% to cover cost incurred in correcting inaccurate orders. To avoid accidental duplication of a verbal (telephonic) order, DO NOT send written confirmation of an order without clearly stating that it is a confirmation only and not a new order. If sent, it must show the same purchase order number stated on the phone or order form and must be marked Confirmation of Phone Order.
FREIGHT
Title passes to the customer at the time your shipment is delivered to the freight carrier (FOB). Freight claims for lost or damaged goods are the responsibility of the customer, however, MSSE will assist wherever possible. Please inspect (see below) all material received and note on the bill of lading (BoL) any damages or shortages before signing, and notify your local freight agent to secure settlement. DO NOT SIGN A BoL AS CLEAN IF THERE IS ANY DAMAGED OR MISSING PRODUCT.
Inspect All Merchandise At Time Of Delivery
Inspect all shipments and check against the included packing list for shortages and damage. Note any damages or shortages on the Bill of Lading. MSSE will not responsible for damage or loss in transit. Again, we will assist in filing a freight claim, but the claim must be made by you. Please notify MSSE of any shortages or damage within 5 working days of receipt. Claims cannot be considered after 30 days.
RETURNS - Click Here
MSSE will accept the authorized return of all standard products for any reason within 30 days of shipment. The product must be unused and in undamaged condition. SPECIAL/CUSTOM ORDER ITEMS ARE NOT RETURNABLE. All returned goods must be accompanied and clearly marked with “RA#XXX”, MSSE return authorization (RA) number which is supplied by our customer service department. All returned merchandise must be shipped prepaid and a returned goods authorization number must appear on the shipping label. Customer is responsible for both the original shipping and return shipping cost and up to a 20% restocking charge plus repair costs incurred due to damage. Any product that cannot be returned to a sellable condition will not be refunded.
WARNING:
All sporting activities carry the risk of injury to the participants. Improperly maintained or improperly used equipment and inadequately supervised programs are significant contributing factors which are out of our hands. All equipment must be thoroughly inspected before each use and properly maintained to reduce the risk to the users.
